1. Introduction

These Terms and Conditions (“Terms”) govern the use of the SMSPay mobile application and related services (“Service”). By installing or using the SMSPay app, you agree to be bound by these Terms.

Please read them carefully. They explain your rights, responsibilities, and how SMSPay operates as a transparent platform connecting verified businesses with users who choose to share their unused SMS capacity.

2. Overview of the Service

SMSPay enables verified local businesses to deliver one-time passwords (OTPs) and service notifications through participating users’ mobile devices.

The price they set per SMS.
The maximum number of messages their device may send or receive.
When to pause or stop participation.

Users are compensated per message successfully transmitted through their device in accordance with their chosen settings.

3. Eligibility

You must be of legal age in your country to enter into a binding agreement. By registering for SMSPay, you confirm that you are the owner or authorized user of the mobile device and SIM card used with the Service.

4. Compliance and Legality

Transactional (e.g., OTPs, service alerts, account notifications).
Sent only to verified local recipients.
Fully compliant with local telecom and data protection laws.

SMSPay does not send or allow marketing, promotional, or bulk advertising messages.

5. User Control

Set or change your price per SMS at any time.
Adjust or limit the number of messages sent per day or month.
Pause or stop the service whenever you choose.

SMSPay may temporarily suspend activity for compliance, technical, or security reasons but will never use your device without your consent.

6. Registration and Security

To use the Service, you must complete registration with accurate, up-to-date information. You are responsible for keeping your account credentials secure and notifying SMSPay of any unauthorized use.

Attempts to gain unauthorized access or interfere with SMSPay systems are strictly prohibited and may result in account suspension or legal action.

7. Privacy and Data Protection

SMSPay is committed to GDPR compliance and user privacy. We never access or store your personal SMS, contacts, or private communications. Only authorized, pre-approved business messages are transmitted through the app.

All data transfers are encrypted and processed in accordance with EU General Data Protection Regulation (GDPR) standards.

8. Compensation and Payment

You are compensated per successfully sent or received SMS based on your selected price and message volume. The rate per message may vary depending on network or local conditions.

Payments are processed through verified third-party payment systems (bank transfer, crypto, or other local methods, depending on your region). You can request withdrawals at any time above the minimum threshold displayed in the app.

All compensation is considered reimbursement for providing SMS transmission capacity. You are responsible for any applicable taxes or declarations under your local laws.

9. Mobile Plan and Charges

Before participating, ensure your mobile plan includes sufficient SMS allowance. You are responsible for any charges applied by your mobile operator, just like when sending a normal message. SMSPay is not responsible for additional costs charged by your telecom provider.

10. Acceptable Use

You agree not to use SMSPay for any illegal or unauthorized purposes. You must not modify, reverse engineer, or interfere with the app’s operation. SMSPay reserves the right to suspend or terminate any account involved in fraudulent, abusive, or non-compliant activity.

11. Service Availability and Limitation of Liability

SMSPay aims to provide continuous, reliable service, but temporary interruptions may occur due to network or system maintenance. The Service is provided “as is” without warranties of uninterrupted performance.

To the fullest extent permitted by law, SMSPay shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. If any claim is found valid, SMSPay’s liability is limited to the total amount paid to you during the three months prior to the claim.

12. Intellectual Property

All software, content, and trademarks related to SMSPay and SMSMarket remain the property of Nettora Systems OÜ. You are granted a non-exclusive, non-transferable license to use the app solely for its intended purpose.

13. Termination

You may stop using the Service at any time by uninstalling the app. SMSPay may suspend or terminate accounts involved in misuse, fraud, or violations of these Terms. Upon termination, any pending payments will be processed according to our payment schedule.
